Правове регулювання публічних видатків в галузі охорони здоров’я в Україні

Abstract

У дисертації визначено категорію публічних видатків в галузі охорони здоров’я та основні принципи їх здійснення. Досліджено методи фінансування галузі охорони здоров’я та здійснено класифікацію публічних видатків цієї галузі. Сформульовано визначення поняття «функції публічних видатків в галузі охорони здоров’я», визначено їх сутність та основні ознаки. Досліджено законодавче забезпечення здійснення публічних видатків в галузі охорони здоров’я в Україні. Визначено проблемні питання правового регулювання публічних видатків в галузі охорони здоров’я України. Здійснено фінансово-правовий аналіз міжнародно-правових стандартів та досвіду зарубіжних держав з побудови правової моделі здійснення публічних видатків в галузі охорони здоров’я. Досліджено проблеми обрання оптимальної моделі фінансування видатків в галузі охорони здоров’я. Розроблено пропозиції щодо вирішення проблеми конституційно-правової регламентації права на охорону здоров’я в контексті реформування фінансування видатків в цій галузі. Запропоновано авторський підхід до реформування системи законодавства щодо регулювання публічних видатків в галузі охорони здоров’я. The thesis defines the category of public expenditures in the health care industry and the basic principles of their implementation. The methods of financing the health care industry have been investigated and the public expenditures of this industry have been classified. The definition of the concept of «public expenditure function in the healthcare sector» is formulated, their nature and main features are defined The legislative support of public spending in the healthcare industry in Ukraine is investigated. The problematic issues of legal regulation of public spending in the healthcare sector of Ukraine are identified. The financial and legal analysis of international legal standards and the experience of foreign countries in building a legal model of public spending in the health sector. The problems of choosing the optimal cost financing model in the healthcare industry are investigated. Proposals have been developed to solve the problem of constitutional regulation of the right to health care in the context of reforming the financing of expenditures in the health sector. The author’s approach to reforming the system of legislation in the field of regulation of public spending in the healthcare industry is proposed.
